Our client operates a fleet of tugs and barges in the Colombia River system on the US West Coast. Several of the tugs were experiencing overheating issues and we were requested to investigate the possibility of a design issue within the engine cooling systems. After extensive historical research and co-operation with the clients’ technical staff, we finally identified a design fault in one of the cooling system components. We subsequently submitted a claim to the manufacturers for the various refurbishment work that had to be undertaken in replacing the defective component on each of the affected tugs. This claim required very sensitive handling with the opponent concerned, as they were actively working with our client on a regular basis. We finally managed to obtain financial compensation of US$120,000, plus various free replacements parts for our client from said supplier/manufacturer.
